www.aceitp.org is the information site of the Association of Computer Engineers and I.T. Professionals.

The following Terms and Conditions constitute an agreement between you and the Association of Computer Engineers and I.T. Professionals (ACEITP) "the Association".

When using the Association’s website, including any restricted area which is accessed by Association Members, registered users or subscribers, you must observe these Terms and Conditions.

2. Intellectual Property Rights

All content of the Association’s website is protected by copyright and other intellectual property rights, which are owned by or licensed to the Association.

All of the Association’s names, images, logos and literature are protected by copyright and other intellectual property rights, which are owned by or licensed to the Association.

You may view the Association’s website and print hard copies of material from it for your personal, non-commercial use.

3. Content

Whilst the Association endeavours to ensure that the information on the website and in all literature distributed by, or produced by the Association, is accurate and complete, the Association is unable to guarantee that, and no liability is accepted for any errors or omissions.

The website may contain links to other sites, which the Association has no jurisdiction over. The Association makes no representation or warranty that the links or any linked information are free from defects or viruses or infected, corrupted or damaged files and shall not be liable for any errors or omissions in any linked information.

The Association reserves the right to modify, add or delete any information or links contained on the website at any time and without notice.

4. Liability − Use of Website

The Association will, in no circumstances be liable for any direct or indirect consequential punitive or special loss or damages arising out of or incidental to the use of the website or its links.

Whilst the Association endeavours to ensure the continuity of the site is maintained, due to the nature of software and the internet, the Association is unable to guarantee that access to, running of the site or any transaction conducted via the site will be uninterrupted or error free.

The Association shall not be liable if it is unable to process your details due to circumstances beyond its reasonable control.

5. Liability

The Association will, in no circumstances be liable for any direct or indirect consequential punitive or special loss or damages, which is not the fault of the Association, is indirect and not reasonably foreseeable.

The Association will not be liable to you if we are unable to perform an obligation or provide a services to you because of any factor outside our control, including but not limited to Acts of God, industrial action, default or failure of a third party, war, governmental action, or by any act or decision made by a court of competent jurisdiction.

6. Force Majeure

The Association reserves the right to cancel, suspend or vary the operation of its obligations to you if events occur which are in the nature of force majeure including (but without prejudice to the generality of the foregoing) fire, flood, storms, plant breakdown, strikes, lock outs, riot, hostilities, non-availability of material or suppliers or any other event outside its control.

The Association shall not be held liable for any breach of contract or in tort including delict resulting from such an event.

7. Use of Personal Information

The Association will make all necessary personal enquiries to fulfil the vetting of an application.
The Association will pass Member’s personal and company details to the Association’s Insurer and Underwriter.

The Association will pass Member’s business details to members of the public who approach the Association for a referral to an IT professional.

The Association may publish Member’s business details on its website as well as future publications and directories of the Association.

The Association may disclose Member’s information, if required to do so by any legal or regulatory body.

Whilst the Association does not sell, trade or rent Member’s personal data to others at present, it may chose to do so in the future with trustworthy and specific third parties. Any third party to which we may provide, rent or sell data collected from Member’s will be carefully pre-screened, determined by us to be reputable, and will use the data provided solely for services which we determine, in our sole judgement, that Members might find of interest.

Members have a right to ask for a copy of their information and to correct any inaccuracies.
To ensure the Association follows Members instructions correctly and to improve service, communications may be recorded or monitored.

8. Accuracy of Information

Each Member that displays information in any format and using any medium, relating to the Association, shall verify such information and be responsible for the accuracy of the same.

The Association cannot be, and is not, responsible for the accuracy or the content of any such information, the responsibility for which remains solely with the relevant Member.

9. General Notices

The Association reserves the right to change the Terms and Conditions at any time.

Any such change in Terms and Conditions will be effective once reflected in the text of these Terms and Conditions and published on the website.

You should check the Terms and Conditions on the website periodically to ensure that you are aware of and complying with the current version.

English Law shall govern the interpretation, construction, effect and enforceability of this agreement, and you and the Association agree to submit to the exclusive jurisdiction of the English courts for the determination of disputes.

10. Application for Membership

Acceptance for Membership is at the discretion of the Association.

The Association shall endeavour to notify the applicant of its decision within 21 days of an application being submitted.

11. Refusal of Membership

The Association shall be entitled at its sole discretion to refuse an application for Membership.

There is no entitlement to appeal.

For the avoidance of doubt, refusal of an application shall not give rise to any claim in damages.

12. Membership

If a Member omits or suppresses any material information, including material information that is relevant to insurance risk, or if any information/documents provided in the application is found to be false, the Membership of the Association and therefore the professional insurance cover will be retrospectively null and void.

If the information provided by a Member on the application form changes before the Membership expires that Member is obliged to inform the Association who will in turn inform their insurers.

Membership runs for 12 months from the first day of the month following the date of acceptance of the

Membership application.

Membership is personal to the Member and may not be assigned.

13. Membership Fees

Membership fees are due annually and in advance.

The annual fee for Membership £55.00

The annual Membership with Insurance Package is £960,

Applicants with existing insurance arrangements , current and in force may join the Association for a fee of £55.00, providing that;

The insurers are European Union Insurers and/or FSA approved Professional Indemnity and Public Liability Insurers.

The limits of Professional Insurance are not less than £5,000,000 Public Liability £1,000,000 Professional Indemnity

A copy of the Insurance Certificate has been evidenced to the Association.

Upon acceptance, the Member must maintain the insurance coverage in accordance with the terms and limits of 1 and 2 herein or the Association Member may subsequently transfer to the insurance coverage provided through the Association, in which case the annual Membership fee will be £960 per annum.

At all times a Member of the Association must be insured in accordance with provisions 1 and 2 herein.

The Association may, at any time, change these fees.

If any fee remains unpaid for 30 days, the Association (or other person appointed by the Association for this purpose) shall be entitled to suspend or terminate the Membership.

Payment must be made upon application to the Association and if Membership is refused for any reason payment(s) made will be refunded in full.

The Association reserves the right to request a criminal record check, the cost of which is payable by the applicant.

14. Cancellation

If a Member decides to cancel Membership, the Member must inform the Association in writing.

If the Member cancels Membership, the Member will receive a pro-rata refund for the remaining whole months of their 12 month membership.

If a Member decides to cancel Membership all membership benefits including insurances will cease from the date written notification is received. No refund will be payable.

15. The Consumer Protection (Distance Selling) Regulations

In accordance with The Consumer Protection (Distance Selling) Regulations 2000 applicants have the right of cancellation in respect of the Membership purchased.

This right shall expire seven working days after the date of application and all monies paid by the Member will be refunded within 30 days of the Association receiving the notice of cancellation in writing.

16. Termination Due to Inappropriate Conduct

The Association reserves the right to terminate the Membership of any Member at any time and with immediate effect where the Member has behaved inappropriately, including breach of these Terms and

Conditions, or where the Member has behaved in such a manner as to generally bring the Association into disrepute.

In these circumstances, any refund of Membership fees will be at the discretion of the directors.
